Terms of Service

1. Services

Tire Swap provides mobile automotive maintenance services, including but not limited to:

  • Tire installation and replacement
  • Tire rotations and balancing
  • Oil changes
  • Brake services
  • Fleet and commercial vehicle maintenance
  • On-site and roadside tire-related services

Services are provided at customer-designated locations and may vary based on vehicle type, location, weather, technician availability, and equipment limitations.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use our Services.

3. Service Availability

Tire Swap does not guarantee service availability at any specific time or location. Services may be delayed, rescheduled, or canceled due to factors including but not limited to technician availability, traffic conditions, equipment issues, weather, safety concerns, or supply limitations.

4. Customer Responsibilities

You agree to:

  • Provide accurate vehicle, location, and contact information
  • Ensure the vehicle is legally accessible and safe to service
  • Remove personal belongings that could interfere with service

Tire Swap may refuse or discontinue service if conditions are unsafe or information provided is inaccurate.

5. Payments & Fees

  • Pricing is disclosed prior to service unless otherwise agreed in writing.
  • Payment is due at the time of service unless part of an approved fleet or subscription agreement.
  • Failure to pay may result in service suspension, late fees, or collections.

6. Cancellations & No-Shows

Appointments may be canceled or rescheduled in accordance with the terms provided at booking. Late cancellations or no-shows may result in fees.

7. Communications Consent

7.1 Consent to Contact

By providing your phone number or email address, you expressly consent to receive communications from Tire Swap, including:

  • Phone calls
  • SMS/MMS text messages
  • Voicemail messages
  • Emails

Communications may include appointment confirmations, service updates, billing notices, and customer support messages. Message and data rates may apply.

7.2 Message Purpose

Communications are primarily transactional and service-related. Promotional messages, if any, will only be sent where legally permitted and with appropriate consent.

7.3 Opt-Out

You may opt out of text messages at any time by replying STOP.
For help, reply HELP or contact us directly.

7.4 Prohibited Messaging

Tire Swap does not send:

  • Spam or unsolicited bulk messages
  • Deceptive or misleading content
  • Messages related to illegal activity
  • Adult, hateful, or abusive content

8. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Interfere with our systems or communications
  • Provide false or misleading information
  • Attempt unauthorized access to our systems

Violation may result in service termination.

9. Vehicle Condition & Service Limitations

Tire Swap is not responsible for pre-existing vehicle conditions, mechanical failures, corrosion, damaged components, stripped lug nuts, aftermarket modifications, or manufacturer defects not directly caused by the service performed.

If a vehicle or component cannot be serviced safely, Tire Swap reserves the right to refuse or discontinue service.

10. Fleet & Commercial Accounts

Fleet and commercial services may be governed by separate written agreements. In the event of a conflict, the fleet agreement shall control.

11. Force Majeure

Tire Swap shall not be liable for delays or failure to perform services due to causes beyond its reasonable control, including severe weather, accidents, vehicle breakdowns, supply shortages, acts of God, government actions, or emergencies.

12. Payment Disputes & Chargebacks

Customers agree to contact Tire Swap directly to resolve billing disputes before initiating chargebacks. Unauthorized or fraudulent chargebacks may result in service suspension and administrative fees.

13. Right to Refuse Service

Tire Swap reserves the right to refuse or discontinue service for safety concerns, policy violations, abusive behavior, inaccessible locations, or inaccurate information.

14. Disclaimer of Warranties

Services are provided “as is” and “as available.”
To the fullest extent permitted by law, Tire Swap disclaims all implied warranties, including warranties of merchantability and fitness for a particular purpose.

15. Limitation of Liability

To the maximum extent permitted by law:

  • Tire Swap shall not be liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed the amount paid for the service giving rise to the claim.

16. Indemnification

You agree to indemnify and hold harmless Tire Swap, its employees, contractors, and affiliates from claims arising from:

  • Your misuse of the Services
  • Violation of these Terms
  • Inaccurate information provided by you

17. Independent Contractor Relationship

Tire Swap technicians are independent contractors. Nothing in these Terms creates an employment, partnership, or joint venture relationship with the customer.

18. Intellectual Property

All logos, branding, text, and content are the property of Tire Swap and may not be used without written permission.

19. Termination

We may suspend or terminate Services at our discretion for violations of these Terms or applicable law.

20. Governing Law & Venue

These Terms are governed by the laws of the State in which Tire Swap is headquartered. Any disputes shall be resolved exclusively in the state or federal courts located within that jurisdiction.

21. Changes to These Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
